Terms of Service

Last updated: 20 September 2026

1. Who you are contracting with

Gesture Cook is operated by Silvan Metzker, PickPost PT844713, Pumpwerkstrasse 56, 8105 Regensdorf, Switzerland. Contact: mail@silvanmetzker.com.

2. Accepting these terms

By using Gesture Cook you agree to these terms. If you do not agree, please do not use the app.

3. Who can use Gesture Cook

You must be at least 16 years old.

4. Your account

You are responsible for what happens under your account and for keeping your login details to yourself. Please tell us promptly if you think someone else is using it.

You can delete your account at any time from inside the app. Deleting it permanently removes your profile, your recipes — public and private — your lists, your comments and your uploaded images. This cannot be undone.

5. Subscriptions

Gesture Cook offers an auto-renewing subscription. Purchases are made through Apple or Google, and their terms govern billing, renewal, refunds and cancellation. You can manage or cancel in your Apple Account or Google Play settings.

6. Content you create

You keep ownership of the recipes, photos and comments you create.

When you publish content publicly, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and distribute it for the purpose of operating Gesture Cook, and to show it in the app, on gesturecook.com and in previews when someone shares a link to it. This licence ends when you delete the content or your account, except for copies we are legally required to keep and copies other users may already have saved offline.

You must have the right to publish what you publish

Copying a recipe out of a cookbook, a magazine or someone else's website and publishing it here is not something you are entitled to do. A bare list of ingredients is generally not protected by copyright, but the way instructions are written, introductions, headnotes and photographs generally are.

The scan feature exists to digitise your own recipes — a family card, your handwriting, something you wrote. It is not a way to copy someone else's book into Gesture Cook.

7. AI features, and what they are not

Miso uses generative AI. Three things follow, and they matter:

It gets things wrong. AI-generated recipes can contain incorrect quantities, unsafe cooking times or temperatures, steps that do not work, or ingredients that do not belong together. Calorie and nutrition figures are estimates produced by a model, not measurements, and must not be relied on for any dietary or medical purpose.

It is not allergen advice. Gesture Cook does not identify allergens and cannot tell you whether a recipe is safe for you or for anyone you cook for. If you or someone at your table has an allergy, an intolerance or a medical dietary requirement, check every ingredient yourself. Do not rely on this app for that.

What you publish is yours. Every recipe is shown to you to review and edit before you choose to save or publish it. When you publish, you are the author of what you publish, whatever wrote the first draft.

Recipes written by AI are labelled in the app and carry a marker recording that. The marker stays after you edit, and you must not remove it or misrepresent it.

Using the AI features requires your consent to your input being sent to our AI provider — see the Privacy Policy. You can withdraw that at any time under More → AI features.

8. What you may not do

Do not publish content that:

  • infringes anyone's copyright, trademark or other rights;
  • is unlawful, defamatory, harassing, hateful or threatening;
  • is sexual content, or sexualises or endangers children;
  • describes something intended to be harmful to eat, or presents something dangerous

as safe;

  • is spam, undisclosed advertising, or a deliberate attempt to mislead;
  • impersonates someone else.

Do not attempt to break, overload or reverse-engineer the service, scrape it at scale, or use it to build a competing dataset.

9. Reporting, moderation and removal

Reporting content. In the app, use the report action on any recipe, and the report action on an AI result you have not saved. You can also block an author, which stops you seeing their recipes and comments.

Reporting from outside the app. Anyone — including people without an account — can report content they consider illegal or in breach of these terms by emailing mail@silvanmetzker.com. Tell us which recipe (a link is ideal) and why. We will confirm we received your report and tell you the outcome.

How we moderate. We review reports by hand. No automated system decides whether published content is removed. Separately, the AI provider behind Miso may refuse to produce a recipe from a request it judges unsuitable — that is an automated decision, and it happens before anything is published.

What we may do. We may remove content, limit who can see it, or suspend or terminate an account.

Telling you why. If we remove your content or restrict your account, we will tell you what was affected, the reason, and how to contest it.

Contesting it. Reply to the notice we send you and we will look again. If you remain unhappy, you can go to a court, or to an out-of-court dispute settlement body certified under the Digital Services Act in your country.

10. Ending it

You can stop using Gesture Cook and delete your account at any time.

We may suspend or terminate your account if you breach these terms or if we are legally required to. Where it is reasonable, we will warn you first; for serious or repeated breaches we may act immediately.

11. Our own content

The app, its name, its design and its software are ours and remain ours. These terms give you no licence to them beyond using the app normally.

12. Disclaimers and liability

Gesture Cook is provided as it is. We do not promise it will be uninterrupted or error-free, and we do not warrant the accuracy, safety or suitability of any recipe, whether written by a person or by AI. Please read section 7.

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data or profit.

Nothing in these terms excludes or limits our liability for death or personal injury, for intent or gross negligence, for fraud, under product liability law, or for anything else that cannot lawfully be limited. Under Swiss law an advance exclusion of liability for intent or gross negligence is void in any case, and if you are a consumer, nothing here affects the mandatory consumer protections of the country you live in.

13. Governing law and where disputes go

These terms are governed by Swiss law, and the ordinary courts of Zurich, Switzerland have jurisdiction.

If you are a consumer living in the EU or EEA, this does not deprive you of the protection of the mandatory law of your own country, and you keep the right to bring proceedings in the courts where you live. We will only bring proceedings against a consumer in the courts of the country where they live.

14. Changes

We may update these terms. The new version is posted here with a new date. If a change is material, we will give notice in the app before it takes effect.
